A lawsuit against SunTrust alleges that certain of its overdraft fees constitute usury, conversion, and money had and received. The case is Bickerstaff v. SunTrust Bank, Civil File No. 10EV010485, State Court of Fulton County, Georgia. SunTrust denies that the fees it charged in connection with overdrafts constitute interest and further denies that it violated any law or is liable for any of the claims asserted in the lawsuit. The parties have agreed to settle the lawsuit to avoid further litigation.

Who Is Included in the Settlement Class?

Every person who had or has one or more accounts with SunTrust Bank that was not closed before June 1, 2010 and who, from July 12, 2006 to April 15, 2014:
  • had at least one overdraft of $500 or less resulting from an ATM or debit card transaction;
  • paid any overdraft fees as a result of the transaction;
  • did not receive a refund of those fees; and
  • was a Georgia citizen on July 12, 2010 and continuously remained a Georgia citizen through October 6, 2017.

Do nothing

Settling Class Members do not need to do anything now. If you are a Settling Class Member:

  • You will be entitled to a cash payment from the Settlement Funds if you submit a timely and valid Claim Form.
  • Once the Settlement becomes final, you will be bound by Court rulings and included in the judgment in this case.
  • You may enter an appearance through counsel, but you do not need to.

Request Exclusion from the Settlement (“Opt Out”)

You can ask to be excluded from the Settlement Class in writing. If you are excluded from the Settlement, you will not receive any of the Settlement Funds.

The Court will exclude from the Settlement Class any Class Member who submits a timely and valid request for exclusion.

Stay in the Settlement Class but Object to the Settlement

To object to the Settlement, you must file a written statement with the Court that contains certain specific information. You can also ask to speak at the Fairness and Final Approval Hearing about your objections.
